Cabinet Office issues Procurement Policy Note Modernising the Public Procurement Rules - On 10 August 2011 the Cabinet Office issued a Procurement Policy Note outlining the strategy the Government is pursuing to influence the European Commission's proposals for a revised and updated public procurement directive.

Next steps for implementation of the Digital Economy Act - Following the Government's successful defence of the Digital Economy Act in judicial review, this paper, published on 3 August 2011, sets out the plans of the Department for Culture, Media and Sport to move forward with the implementation of the enforcement measures in the Digital Economy Act.

Rioters to be tracked down through the use of their Blackberry's - UK police may be able to make use of rioter;s mobile phone information to help convict them. Top Ten issues in Outsourcing - This webinar built on DLA Piper's vast experience of the outsourcing sector by looking at what is felt to be the key issues arising in outsourcing contract negotiations, and the trends which may be observed in relation to them. "Negotiating IT Contracts" Masterclass - On 12 July 2011 Rebekah Flaherty, a senior Associate (Australian Qualified) in our London office presented a full day masterclass on "Negotiating IT Contracts" through the Ark Group.

The masterclass focused on the particular issues and risks to consider when procuring IT products and services, covering a range of topics including:

  • the relationship between commercial risks and the terms of the IT contract
  • legal issues affecting the most common IT projects
  • which risks can be managed through the contract and which can't?
  • contracting models in the IT sector
  • negotiating tactics: key issues and the key contractual clauses
  • disputes and defaults: protecting your legal rights and remedies
  • exit strategies: ensuring a seamless transition and business continuity

Attendees participated in an interactive exercise to identify and discuss practical legal and commercial solutions to problems and risks arising in realistic IT procurement scenarios.
